very disturbing news.
what i wonder is... if the victim committed suicide before the trial, where did the judge get his "character" assessment from?

BILLINGS, Montana.

"A former teacher sent to prison for 30 days for raping a student is set to return to court Friday because the sentence may have been illegal, but the move has failed to quiet criticisms of the judge overseeing the case.

District Judge G. Todd Baugh said Tuesday that state law appears to require a two-year mandatory minimum prison term for Stacey Rambold, 54, of Billings.

Rambold was sentenced last week to 15 years with all but 31 days suspended and a one-day credit given for time-served. He has begun serving his month long term at the state prison in Deer Lodge.

The judge has faced widespread condemnation from activists, elected officials and others for the sentence and for saying Rambold’s 14-year-old victim was “older than her chronological age” and asserting that she had some control over her months-long relationship with Rambold.

U.S. judge apologizes for saying teen was as much in control of the situation as teacher who raped her.

"She wasn't even old enough to get a driver's license. But Judge Baugh, who never met our daughter, justified the paltry sentence saying she was older than her chronological age," the victim's mother said in a statement to the Gazette after Monday's sentencing. "I guess somehow it makes a rape more acceptable if you blame the victim, even if she was only 14."

Baugh, 71, wrote an apology Wednesday in a letter to the editor to The Billings Gazette. He said his comments were demeaning of all women and not reflective of his beliefs.

The judge later told reporters he was "fumbling around" in court trying to explain his sentence and "made some really stupid remarks."


Under state law, children younger than 16 cannot consent to sexual intercourse.

"Ex-Montana teacher Stacey Rambold, 54, recently walked out of the Montana State Prison in Deer Lodge after serving an incredibly light sentence, considering his crime, given by District Judge G. Todd Baugh of Billings. Rambold was convicted of raping 14-year-old Cherise Moralez in 2007.

The judge drew outrage over the sentence's leniency and comments he made that appeared to pin some of the blame on Moralez.

State prosecutors are appealing the sentence, saying Rambold should have received a minimum of two years. But barring new offenses, the former teacher has served his time and will stay out of prison pending the appeal
