It seems to me that this law in Delaware as well as the one in California violates Article 1, Section 9 of the United States Constitution which guarantees that Congrees shall pass no ex post facto laws. This statute was passed along to the states along with the other limitations of Congress by the Fourteenth Amendment which states "No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws."
I'm not in favor of breaking the law to protect children, as a government that is seen as being a protector of children is generally excused of violating the most perverse of atrocties.
